Legal Notice Public Auction of Real Property Delaware City School District The Board of Education (the “Board”) of the Delaware City School District (the “District”) will be holding a public auction of approximately 1.407 acres of real property owned by the Board located at 248 North Washington Street, Delaware County, Delaware, Ohio, including all improvements located thereon, commonly known as the former Board of Education Building, aka the former Admin Building, and further known as Delaware County Auditor Parcel Number 519-432-02-009-000 (the "Property"). Date/Time/Place: The auction will be held beginning at 5:30 p.m. on Thursday, June 12, 2025 (with registration beginning at 4:30 p.m. ) and will be conducted at the Board offices in the Willis Education Center, located at 74 W. William St., Delaware, Ohio 43015. Minimum Bid/Sale Subject to Board Approval: The sale shall be subject to a minimum opening bid (the “Minimum Bid”) of Five Hundred Thousand and no/100 Dollars ($500,000.00). The sale shall be made to the highest bidder, SUBJECT TO BOARD APPROVAL. The Board shall meet on June 12, 2025, after the conclusion of the auction. The BOARD RESERVES THE RIGHT TO REJECT ANY AND ALL BIDS, even bids which are at or above the Minimum Bid. Contract Execution/Deposit: Immediately upon conclusion of the auction, the high bidder shall (a) sign the Auction Real Estate Purchase Contract (the “Auction Contract”); and (b) shall pay a deposit (the “Deposit”) in the amount of Fifty Thousand Dollars ($50,000.00) by cashier’s check from a financial institution, made payable to Delaware City Schools. The Deposit shall be (i) applied against the purchase price if the Board approves the high bid; (ii) returned to the high bidder if the Board rejects the high bid; or (iii) retained by the Board if the Board approves the high bid but the high bidder does not complete the purchase of the Property. Other Terms of Sale: If the Board accepts the high bid, the balance of the purchase price shall be payable at closing, with the closing to occur no later than June 30, 2025. The sale of the Property shall be “AS IS, WHERE IS”. Only unconditional bids shall be accepted. By way of example, no bids shall be conditioned on buyer obtaining financing, permits, inspections or governmental approvals. The auction shall be further subject to all terms and conditions more specifically outlined in the Auction Contract. Possession/Existing Lease: The Board shall deliver possession of the Property to the high bidder at closing, subject to the rights of the current tenant under its lease (the “Lease”), which Lease term expires July 31, 2025. The Lease shall be assigned to the high bidder at the closing.
