LEGAL NOTICE NOTICE OF INTENT TO CANCEL OIL AND GAS LEASE UNDER ORC §5301.332 Notice to Floren W. McNichols and Betty J. McNichols, and their successor and assigns, pursuant to Section 5301.322 of the Ohio Revised Code, you are hereby given notice that the oil and gas lease dated October 6, 1983 (the “Lease”), by and between Floren W. McNichols and Betty J. McNichols (as “lessors”) and Conquest Exploration Company of Houston, Texas (the “lessee”), recorded in Lease Record Volume 42, Page 702 of the Delaware County, Ohio Recorder’s Office, has terminated as a matter of law and will be forfeited. All of Conquest Exploration Company’s interest was subsequently assigned. Each of the individuals identified above may own a working interest in the Leased Premises. The Leased Premises are described as 100.9 acres, Kingston Township, Delaware County, Ohio, and will be forfeited because the primary term of the Lease of three (3) years has expired; no oil and/or gas wells were drilled on the Leased Premises or lands pooled; there are no producing oil or gas wells on the Leased Premises and the lessee and their successors and assigns have not made the consideration or payment under the lease necessary to reinstate the Lease into effect. Robert W. Potts and Peggy Ann Piro fka Peggy A. Potts are the current owner of the property known as Parcel No. 517-100-01-084-001, containing approximately 7.031 acres, more or less, and described in a Deed recorded in Book 1369, Pages 2019-2020, Delaware County, Ohio Recorder’s Office. It is our intention to file for record an affidavit of forfeiture with the Delaware County Recorder’s Office if you do not have the Lease released of record within thirty (30) calendar days from publication of this notice.
